Law. Codifying the UK constitution Academic Essay

Law. Codifying the UK constitution

Question
The Minister for Justice in the UK is intending to set in motion a process of constitutional reform to codify the UK’s constitution. The Minister has written to you requesting legal advice on aspects of a constitutional reform of this kind.
The Minister has sent you a letter outlining the vision of the UK’s new codified constitutional framework:
The UK ought to have a constitutional code. Particularly, this code should state core fundamental rights similar to the German Grundgesetz. The list of fundamental rights should include those inherent to the South African constitution.
Constitutional conventions are to be codified.
The Minister’s letter is asking you for your advice regarding:
the challenges of codifying the UK’s constitutional framework, focussing on the aspects above
the challenges of using the German and South African constitutions as a model for a codified UK constitution
the advantages and disadvantages of codifying conventions and how codification would impact the UK’s constitutional framework
Draft a legal advice memorandum advising the Minister on a constitutional reform of the kind envisaged, supporting your advice by reasoned arguments. You are NOT expected to engage in a discussion of the Human Rights Act or a UK Bill of rights.
You are required to draft your legal advice memorandum in this legal advice memorandum template.
