The power dynamic between states and the federal government has been a longstanding debate in the United States. While the Constitution outlines the powers of the federal government, states have their own powers and responsibilities as well. However, in recent years, the power of the federal government has grown, leading to concerns about state sovereignty and autonomy. So, what can states do to counteract the power of the federal government?

One strategy that states can employ is the use of legal challenges. States can challenge federal laws and regulations in court, arguing that they violate state rights or the Constitution. For example, in 2012, the Supreme Court upheld the individual mandate provision of the Affordable Care Act, but it also gave states the ability to opt-out of the Medicaid expansion. Several states challenged the ACA in court, arguing that it was unconstitutional and violated states’ rights. Although the Supreme Court ultimately upheld most of the law, this case demonstrates how states can use legal challenges to counter the power of the federal government.

Another strategy is the use of interposition and nullification. Interposition is the idea that states have the right to interpose themselves between the federal government and the people, protecting their citizens from federal overreach. Nullification is the idea that states can declare federal laws null and void within their borders if they believe they violate the Constitution. These concepts were popular in the 19th century, particularly during the debates over slavery and states’ rights. Today, some states have invoked these ideas to push back against federal laws, such as Arizona’s controversial immigration law and Colorado’s legalization of marijuana.

States can also engage in cooperative federalism, which is a collaborative approach to governance where the federal government and states work together to achieve common goals. This approach allows states to have more input in federal policy-making and implementation, which can help to balance the power dynamic between states and the federal government. For example, the Clean Air Act and the Clean Water Act both require collaboration between the government and states to ensure compliance and enforcement.

Finally, states can utilize public opinion and political pressure to counter the power of the federal government. States can mobilize their citizens to lobby Congress and the President for policy changes or to push back against federal overreach. In recent years, we have seen examples of states using public opinion and political pressure to push back against federal policies, such as the backlash against the family separation policy at the southern border and the protests against the repeal of net neutrality.

In conclusion, there are several strategies that states can use to counter the power of the federal government.
