EVALUATION:

1. Does the ad fully comply with the Rules of Professional Conduct in North Carolina regarding lawyer advertising? (In answering this question, you must refer to at least one specific rule by number. Failure to do so will result in a points deduction.) If not, please provide details as to why not.

By the way, don’t get confused: a lot of you have been submitting answers that refer to the ABA Model Rules or Model Code. Those are just models, meaning that they are not necessarily the law as it appears in North Carolina. As I’ve said in the lectures, North Carolina lawyer conduct is governed by the North Carolina Rules of Professional Conduct. Please refer to those rules when you’re answering this question. Reference to the wrong rules will result in points deduction.

2. Does the ad do a good job of informing the consumer of what the firm will do? For example, if the ad speaks of “court costs” or “filing fees,” is it clear whether or not those fees will be owed if the client does not prevail?

3. Do you think the ad is misleading in any way? For example, does it tacitly seem to contain a guarantee that the consumer will win?

4. Does the ad serve the public?

5. Do you think that ads in general, and this ad in particular, are good for the public in providing options and information about their legal rights, or do they just stir up unnecessary litigation?
